US Terms and Conditions
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. They govern the relationship between you and Vecto Mobile and describe the rights and obligations of Vecto Mobile and its Customers concerning the delivery, performance and use of the Products and Services in the USA. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION THAT DISALLOWS CLASS ACTIONS, A CLASS ACTION WAIVER PROVISION, AND A JURY WAIVER PROVISION.
IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT USE THE SERVICE OR PHONE AND NOTIFY US IMMEDIATELY AT 1-800-92VECTO (1-800-928-3288) TO CANCEL SERVICE.
1.1 Acceptable Use Policy: The policy governing the use of the Products and Services by a Customer whether required by Vecto Mobile or the telecommunications operator of any Network that facilitates access to the Services. The Acceptable Use Policy is described in Section I and III below.
1.2 Account: The mobile telephone account registered or activated by a Customer that Vecto Mobile uses to provide the Products and Services and which logs a Customer’s use of the Products and Services.
a. In addition to these general terms and conditions, there are several parts of the Agreement, which may include but is not limited to i) the User Guide accompanying the SIM Card or available at www.vectomobile.com; ii) the Charges for Services published by Vecto Mobile from time to time, including any special offers; iii) the transaction materials that you sign or accept (via electronic acceptance online or through a Vecto Mobile retail location or that of an authorized retailer) during the sales transaction (if your service plan is not specifically set forth in any printed materials, the requirements and terms set forth in the current written services and transaction materials apply, excluding the plan charges and number of minutes included in your service plan); and (iv) any confirmation materials that we may provide to you.
b. The Agreement starts when a Customer purchases a SIM Card, registers or activates an Account, uses our Top-Up Services, or uses our Services, whichever occurs first.
You must have the legal capacity to accept these Terms and Conditions (the “Agreement”). You accept the Agreement when you do any of the following: (a) accept the Agreement through any printed, oral, or electronic statement, for example, on the Web by electronically marking that you have reviewed and accepted; (b) activating Service; (c) attempt to or in any way use the Services; (d) pay for the Services or a SIM (purchased from Vecto Mobile, a Vecto Mobile dealer, or other Vecto Mobile authorized retailer); or (e) open any package or start any program that says you are accepting the Agreement when doing so. If you don't want to accept the Agreement, don't do any of these things.
1.4 Charges: The charges applicable from time to time for the use of the Services, including any connection fees and special offers. Charges do NOT include Taxes, Fees and Surcharges. The current charges are available at http://www.vectomobile.com. Select your country of use as shown for a list of charges.
1.5 Customer: Any individual, company or other entity that purchases a SIM Card, Top-Up Voucher, registers or activates an Account with Vecto Mobile or uses the Services. In these general terms and conditions, the Customer is sometimes referred to as "you" or "your".
1.6 Customer Services Department: The department of Vecto Mobile that you may contact for any enquiries about the Products or Services. You may contact the Customer Services Department in several ways:

- Write to Customer Services Department at the address listed in Section 1.18 below
1.7 Device: An unlocked GSM mobile telephone, handset, or other device used to access the Services. You shall be responsible for ensuring that your mobile device is compatible with the Services that you purchase from us. This may include ensuring that your handset is 'unlocked' and is compatible with the network in the country where you wish to use it.
1.8 Network: The telecommunications networks used by Vecto Mobile to provide the Services to you.
1.9 Personal Data: The personal information that you provide to Vecto Mobile or that Vecto Mobile generates, collects, uses, processes and stores about you while providing the Services, including but not limited to your name, address, ID Document type & number, date of birth, mobile telephone number, call data records including Traffic Data and Location Data, top-up records, credit card or debit card details, billing records, voice mail recordings, copies of e-mails including your e-mail address, and records of Customer Services Department enquiries made by you.
1.11 Products: The Vecto Mobile SIM Card and Vecto Mobile Top-Up service, and any other branded products offered by Vecto Mobile, including promotional products.
1.12 Services: The mobile telephone services that Vecto Mobile provides to you, including voice calling, messaging and data services, voicemail, calling line identification presentation (CLIP), calling line identification restriction (CLIR), Top-Up Services, Roaming Services and the services provided by the Customer Services Department.
We shall provide you with national and international mobile telecommunications services including voice, text and data services based on the capabilities of a multi-IMSI SIM card. Our Services under this Agreement are provided on a prepayment or pay as you go basis.
Certain types of calls or messages may be excluded from the Services, such as certain premium rate services. We reserve the right to restrict access to these telephone numbers and services.
1.13 SIM Card: The prepaid, pre-activated card that allows you to access and use the Services by inserting the SIM Card into a compatible Device.
1.14 Taxes, Fees, and Surcharges
Taxes and Fees. You agree to pay all taxes and fees imposed by governments or governmental entities. We may not give advance notice of changes to taxes & fees. To determine taxes & fees, we will use the point of sale location (if applicable) or street address you identified as your address. If you did not identify such a location , or if you provided an address (such as a PO box) that is not a recognized street address, which does not identify the applicable taxing jurisdictions or does not reflect the Service area associated with your telephone number, you may be assigned a default location for tax purposes. In the event of a disputed tax jurisdiction location being assigned, any tax refund must be requested within sixty (60) days of our notification to you that the tax has been assessed.
Surcharges . You agree to pay all Surcharges. Surcharges are not mandated by law, they are Vecto Mobile Charges that are collected and retained by Vecto Mobile in whole or in part. The components and amounts of these Charges are subject to change without notice. Surcharges include, but are not limited to charges, costs, fees and certain taxes Vecto Mobile incurs to provide Services (and are not government taxes or fees imposed directly on our customers that we must collect by law). Examples include general and administrative fees (such as certain costs we incur to provide Service) as well as governmental-related Surcharges (such as Federal or State Universal Service fees, E-911 fees, regulatory fees, and gross receipts taxes). Surcharges will apply whether or not you benefit from the programs, activities or services included in the Surcharge. Depending on your Services, we may deduct from your Account balance all Taxes, Fees and Surcharges that we’re required by law to collect and remit to the government on the Services that we provide to you. The number and type of Taxes, Fees and Surcharges will be provided and may vary depending upon the location of the transaction.
1.15 Top-Up Services: The services you may use to add credit to the balance of your Account, including the Top-Up with a dealer or other Vecto Mobile authorized retailer, Online Top-Up and Auto Top-Up.
1.16 Telephone number: We reserve all rights attached to the telephone number(s) attributed to you and attached to the Service provided by us and we may change, withdraw or otherwise alter such telephone number or any other address-element at our discretion, without damages payable to you, should any technical or commercial reason or any applicable regulations so require.
1.17 User Guide: The guide or documentation supplied with your SIM Card or listed at www.vectomobile.com, which explains how you may access and use the Services.
1.18 Vecto Mobile: Vecto™ is a registered trademark of VMNO USA INC, a Florida company, or its affiliates. When used in this Agreement, “Vecto Mobile” means VMNO USA INC, and all of our subsidiaries, affiliates, parent companies, vendors, suppliers, or licensors. In these general terms and conditions, Vecto Mobile is sometimes referred to as "we", "us" or "our". Services are subject to our business policies, practices, and procedures ("Policies"). You agree to adhere to all of our Policies when you use our Services. Our Policies are subject to change at any time with or without notice.
You can add multiple phone numbers to your Multi-IMSI chip from our current list of available countries.
The current list of countries where we offer additional local cell phone numbers for adding additional country numbers can be found on our Website www.vectomobile.com or you can contact our Customer Service, dialing 1-800-92VECTO (1-800-928-3288) or sending an email to firstname.lastname@example.org for an up to date list an additional country number. Vecto Mobile reserves the right to amend this country list from time to time.
You can add an additional country number by using the Vecto Mobile web services at www.vectomobile.com, or by calling the Customer Services Department at 1-800-92VECTO (1-800-928-3288), or at any participating retail point of sale.
There are no limits on the quantity of local country cell phone numbers you can have on a Vecto Mobile SIM, provided the chosen country is a country supported by Vecto Mobile and you have paid the relevant subscription fees for those multiple country numbers
Your use of any numbers assigned to your SIM is subject to these terms and conditions and any breach of these terms and conditions may result in your use of one or more of the allocated numbers being withdrawn from your use.
Local Tariffs for Designated Countries
One of the unique features about the Vecto Mobile Service is the ability to be charged local rates for calls in certain identified countries outside your chosen home country. Assuming you have implemented the associated Vecto Mobile Service, you will be entitled to have access to local rates for your SIM in those identified Vecto Mobile supported countries and you will be able to make and receive calls on your Vecto Mobile SIM at local call rates in those Vecto Mobile supported countries.
Where Vecto Mobile does not have an arrangement with a specific country for the purchasing of local rates, then you may still use your Vecto Mobile SIM but this will be on ‘global calling’, or international roaming, and global rates apply. There is a rate plan for international roaming. See www.vectomobile.com for details.
It is your responsibility to check the billing status (i.e. whether local rates are applicable for the service you are subscribing to, or whether global calling/international roaming rates apply) of the country in which you intend to use the Service before you travel to that country and incur any charges by using the Services in that country. Vecto Mobile will not be liable for any charges incurred by you based on your misunderstanding of the applicable and available tariffs in a particular country.
As with any GSM mobile service, a core feature of the Service is the inclusion of roaming on foreign networks in order to provide the Services outside your chosen home country (Roaming). Roaming means that you will be using foreign networks, over which we have no control and therefore cannot provide any guarantees about the Services, particularly its availability or quality. In addition, your use of the Service whilst roaming may be subject to different laws and regulations that apply. Vecto Mobile shall not be liable for your failure to comply with those laws or regulations.
A. Vecto Mobile SIM CARD Service & Activation. The Service is initiated by inserting the Vecto Mobile SIM Card it into a compatible GSM mobile telephone.
To activate the Service, you must both activate your account and establish an appropriate account balance to pay for applicable subscription charges (defined in the "Activation" section) based on the service plan you select.
You may obtain and activate the Service at any participating retail point of sale, by visiting www.vectomobile.com, or by calling Customer Service at 1-800-92VECTO (1-800-928-3288).
For the activation of the Service, or the use of the Top-Up Services, you may be required to register your Personal Data with Vecto Mobile such as your name, address, ID Document type & number, and your credit card or debit card details if your payment is not in cash.
If Vecto Mobile determines that the Personal Data that you provide is false, Vecto Mobile shall have the right to suspend, partially or fully, your access to the services and/ or terminate this Agreement without prior notice and with immediate effect. If Vecto Mobile terminates this Agreement for this reason, your SIM Card will be deactivated. If the SIM Card is deactivated, your specific telephone number will be reallocated to another Customer, you will not be able to access or use the Services, and you will not be entitled to a refund of any credit balance in your Account.
The SIM Card remains the exclusive property of Vecto Mobile. All technology, intellectual property and documentation relating to it and the Service shall remain our property or the property of any licensor. On purchasing the Services we grant you a revocable, conditional, non-exclusive, non-assignable, non-sub-licensable license to use the SIM card and Services and reserve our rights to recall any SIM card from you.
You must retain the SIM Card and not lose or damage the SIM Card. Vecto Mobile will only replace a SIM Card where it is found to be defective by reason of faulty workmanship or design. Vecto Mobile may charge you for a replacement SIM Card where Vecto Mobile reasonably believes that you are responsible for the loss or damage of your original SIM Card or where someone has stolen your original SIM Card. It is your responsibility to promptly inform Vecto Mobile of any loss, damage or theft to your SIM Card, or any fraudulent or improper use of your SIM Card. You agree that once you start using the Services or the Top Up Services you will lose any right to cancel this Agreement under distance selling legislation.
Associated with your SIM Card is the PIN code (personal identification number), the PUK code (personal unlocking key), and ICCID number (Integrated Circuit Card Identifier). You will take every necessary precaution to preserve the secrecy of your PIN, PUK codes and ICCID number. You will be liable for any fraudulent or improper use of your SIM Card or Account that results from the intentional or accidental disclosure of your PIN, PUK code, ICCID number or the transfer of your SIM Card to another person.
B. Availability/Interruption. Vecto Mobile customers have access to nationwide GSM coverage under the agreement between Vecto Mobile and its underlying carrier and plan terms applicable to Vecto Mobile. Please review the coverage map, which shows a general representation of wireless coverage. The areas shown are proximate. This map may include areas served by unaffiliated carriers and may depict their licensed area rather than an approximation of their coverag. Actual coverage may vary and depends on system availability and system capacity, system repairs and modifications, customer’s equipment, terrain, signal strength, weather and other conditions. Vecto Mobile does not guarantee coverage or network availability. GSM wireless features require a compatible GSM 850/900/1900 dual, tri, or quad band phone, and are only available in the GSM features area. Not all features or Service offerings are available at all locations. Charges will be based on the location of the site receiving and transmitting the call, not your location. Rates apply to calls made within the Vecto Mobile Coverage Area. Your phone's display does not indicate the rate you will be charged.
The Roaming Services, also known as ‘global calling’, are subject to the roaming contracts and service quality levels that have been agreed between other national and international telecommunications operators. Vecto Mobile does not have any control over the contracts or service quality levels agreed between these telecommunications operators. Your device may connect to another provider's network even when you are within the Vecto Mobile coverage area, referred to as being “Off-Net”. Customers should check the device to determine if you are Off-Net. There may be extra Charges (including long distance, tolls, data usage) and higher rates for Off-Net usage, depending on your purchased services.
For the reasons described above, Vecto Mobile does not warrant or guarantee that the services will be uninterrupted or error free (in terms of Network availability, quality or coverage) in all locations at all times, or that the services will be suitable for your specific requirements, or that the services will be completely secure against unauthorized interception.
C. Use of Service/Device/Number. Reproduction, retransmission, dissemination or resale of Service is prohibited without prior written contractual arrangements from Vecto Mobile, Inc. and any required regulatory approvals. You are responsible for ensuring that your device is compatible with our service and meets applicable legal standards. You are responsible for the purchase and maintenance of any additional hardware, software and/or Internet access from your PC required to use the Service. You consent to receiving advertising, alerts and other broadcast messages from Vecto Mobile, Inc. or our authorized agents You shall acquire no proprietary interest in numbers assigned by Vecto Mobile for your use. You have no ownership rights to the number, any IP address, any e-mail address or any other identifier provisioned by us, our agents or the manufacturer of your device to be used with the service, and you agree we may change any such number, IP address, e-mail address or any other identifier at any time with or without prior notice to you. By using the service, you agree to abide by the Terms and Conditions of any applicable software license.
D. Unauthorized Usage. You agree not to use the device or service for any unlawful, unauthorized or abusive purpose or in any way that damages our property or others property, or interferes with, harms or disrupts our system or other operators' systems or other users. You will comply with all laws while using the service and you will not transmit any communication or data that would violate any laws, court order, or regulation, or would likely be offensive to the recipient. You are responsible for all content that you transmit using the service. You may not install any amplifiers, enhancers, repeaters or other devices that modify, disrupt or interfere in any way with the radio frequency licensed to us to provide service. If your device, user name or password is stolen or the service is fraudulently used, you must immediately notify us and provide us with such documentation and information as we may request (including affidavits and police reports). Until you notify us, you will remain responsible for all charges. We have the right to interrupt or restrict service to your Number, without notice to you, if we suspect fraudulent, illegal, or abusive activity. You agree to cooperate with us in any fraud investigation and to use any fraud prevention measures we prescribe. Failure to provide reasonable cooperation may result in your liability for all fraudulent usage.
F. Switching between Service Plans. Unless otherwise provided in the detailed plan or other information we provide or refer you to during the sales transaction, you may switch to any current service plan. In some instances, changes may be conditioned on payment of certain charges. The effective date of any changes will depend on our Policies, the old services, and the requested services. If you switch service plans, you will not receive a refund of any portion of any previously pre-paid service charges and you will may -lose all of your remaining unused minutes, messages, and data allotment. We may—but are not obligated to—provide you the opportunity to authorize someone else to make changes to your services. You are responsible for any changes to your services made by a person you authorize, and those changes will be treated as modifications to this Agreement.
G. Our Right to Change the Agreement. We may change any part of the Agreement at any time, including, but not limited to, rates, charges, how we calculate charges, discounts, coverage, technologies used to provide services, or your terms of service. If a particular rate plan is no longer supported or available, we may change your rate plan to one for which you qualify. We will provide you notice of material changes—and we may provide you notice of non-material changes—in a manner consistent with this Agreement. If you continue to access or use our services or increase your account balance on or after the effective date of a change, you accept the change. Do not access or use our services after the effective date of a change if you decide to reject the change and terminate service. You will not be entitled to any credit for the unused portion of your account balance if you decide to terminate service in response to a change to the Agreement.
H. Your Rights to End this Agreement. You may terminate your service at any time by notifying us of your intention to terminate service. There is no penalty or termination fee; however, it may take up to 30 days to process the termination request and the balance remaining in your account is forfeited upon termination of service. Your service will resume and the termination request will be cancelled if you use your service prior to our processing your termination notification. You must also return the SIM card and any associated products to us within seven (7) days of notifying us of the cancellation, in the same condition in which you receive them (except to the extent reasonably necessary for you to examine them), and at your own cost and risk
A. General. The tariffs applicable from time to time for the use of the services, including any connection fees and special offers. The current tariffs are available at www.vectomobile.com.
Vecto Mobile is a prepaid service with monthly subscription plans and Pay As You Go (PAYG) available with no long-term contracts, no credit checks, and does not send customers monthly bills for services. Vecto Mobile customers may chose a monthly plan or stay with pay as you go.
All charges (including service fees, call charges, SMS charges) shall be quoted in the currency of your nominated home accoun.
These "subscription charges," allow you access to a Service or provide you a certain amount of use of a Service for a defined period of time. Subscription charges for Services end at 11:59 p.m., in the time zone in which your phone number is based, on the last day of your subscription period. Also, depending on your Service, certain types of subscription charges may be assessed automatically upon activation and automatically assessed for subsequent subscription periods
State and local sales taxes & fees may apply. You agree to pay all federal, state, and local taxes, fees, and other assessments that we are required by law to collect and remit to the government on the Services that we provide to you. These charges may change from time to time without advance notice.
You may use the Service choosing one of the different pre-paid monthly subscription and PAYG plans that include: voice, text messages and data.
You are responsible for paying all charges, including but not limited to: airtime, access, features, voice mail access, voice mail delivery, data usage, text messages, downloadable content, alerts, roaming, long distance, directory and operator assistance charges, the price of devices and accessories, charges for other goods and services and shipping/handling fees. You will be billed at domestic airtime or roaming rates (please refer to your Plan) for 800, 866, 877, 888, and other "toll free" calls. Applicable international charges will always be billed for direct dial calls placed from your wireless phone. A long distance provider chosen by Vecto Mobile will provide your long distance. For all calls, the length of the call will be measured during the time that you are connected to our system, which is approximately from the time you press "Send" or other key to begin a call until approximately the time you press "End," or other key to terminate the call. Airtime usage on each call is deducted in full minute increments, with partial minutes of use rounded up to the next full minute. For calls placed in the United States, you will not be charged for busy or unconnected calls if you press "End" or "No" within 30 seconds.
Unanswered calls lasting 30 seconds or more will be charged standard airtime and rounded up to the nearest minute. Call waiting, 3-way calling, call forwarding, voicemail will incur applicable airtime or roaming and wireless long distance charges. Please note you may be charged a higher rate for calls made off-network. You will be charged for any check or electronic bank draft returned for non-payment. Please refer to your Plan or PAYG for details.
Local numbers: You can add multiple available additional cell phone numbers to your account for cell phone numbers in those countries where Vecto Mobile offers this option as part of our Services, for a monthly prepayment subscription rental fee (see tariffs on the Website for current price).
If you decide not to continue with the rental, then the number assigned to you will be disconnected and you will not be able to make or receive calls on this number.
International roaming and dialing are available in all Service Plans and may require an additional feature on your account. Excluding the specific cases of monthly subscription plans and PAYG, which may include local rates for certain countries, whether roaming internationally or making and sending international calls and messages while in the U.S. (or Puerto Rico), you will be charged international rates, (including voicemails left for you and for data usage ). This includes per minute rates for calls and, while roaming internationally, per minute rates for calls transferred to your voicemail and the relevant data rates for data usage. You may be charged for more than one call for unanswered calls that are forwarded to voicemail regardless of whether the calls result in an actual voicemail message being left for you and regardless of whether your phone is on or off. Some devices and applications may incur usage and charges while roaming. You may be able to disable these applications and features through your device settings. Different rates and rounding increments apply in different countries. While roaming internationally, your data throughput may be reduced and your Service may be otherwise limited or terminated at any time without notice.
Data Plans: You will be charged for data usage on a pre-paid basis as part of your service. Rates and charges may be found at www.vectomobile.com and are subject to change.
B. Account Balance, Renewal and Top-Up Services. You are a month-to-month Plan or PAYG customer. All charges incurred will be deducted automatically from your account. Any amounts loaded into your account are not transferable or refundable. You should take reasonable efforts to safeguard your SIM Card. No refunds or other compensations will be given for returned, expired, lost, damaged, or stolen SIM-Card. Vecto Mobile will only replace a SIM Card where it is found to be defective by reason of faulty workmanship or design.
To keep your account active and avoid Service interruptions, you must pre-pay any applicable subscription charges (depending on your Service Plan). Account balances are not transferable, redeemable for cash, or refundable; positive account balances are forfeited if they are not used within the effective period specified in your Service Plan. If you do not use your account balance during the effective period, your account balance will expire and you will not be entitled to a refund or service credit. Your Service will be interrupted if you fail to timely pre-pay applicable Subscription Charges for each effective period. For the avoidance of any doubt, unused Service Plan Allotments expire at the end of the time period associated with your Service Plan. When this Service interruption occurs, you will be given a period of time to make any appropriate payments on your account. If you do not make such payments within this time period, your account will be cancelled. If your account is cancelled, you will lose any phone number, identification number, or email address associated with your account. Reactivation fees will apply if you choose to restart service after suspension.
All Service Plans may provide for automatic pre-pay subscription charges replenishment through automatic billing to a credit card or debit card.
All the Services are Pre-paid Services. You are required to renew your Pre-paid Monthly Subscription Plan or PAYG to maintain uninterrupted service. For Subscription Plans, Top-ups are possible if the monthly plan allotments have been consumed before the effective period. No bill or invoice or statement will be issued to you. You can check your credit balance and expiration date at any time, if applicable, and at no charge, by entering in “SIM Toolkit” Menu and pressing “Balance Check” button on your handset.
You may use the Top-Up Services at any time after your registration or activation of your Account. There are several ways that you may renew your Pre-paid Monthly Plan, PAYG or top-up your Account:
- You may input your credit or debit card details with Vecto Mobile in the “MyAccount” section and chose Auto Renewal your Pre-paid monthly plan. In that case, the top-ups take effect automatically, once a certain predetermined date or balance has been reached.
- You may register your credit or debit card details with Vecto Mobile and then contact the Customer Services Department.
- You may Top-Up in cash, credit card or debit card at any participating retail point of sale. Payment methods may vary by point of sale location.
- You may Top-Up using your credit card or debit card at www.vectomobile.com.
The credit balance in your Account may only be used for the Services. You are not entitled to receive any cash refund for any credit balance remaining in your Account at any time, including where you fail to use the Services and your SIM Card has been deactivated or where this Agreement has been terminated.
Interest is not payable on any credit balance in your Account. Each time you use the Services (or someone else uses your GSM mobile telephone) the credit balance in your Account will be reduced for the voice call, message or data you are making or sending according to the destination and the current charges.
Any dispute to a charge that we assess to you, must be made in writing within 45 days of the expiration date of the effective period of the specified service plan where we deduct the charge. You accept all charges not properly disputed within the above time period
C. How We Calculate Your Charges. Regular Voice Calls: You're charged for all calls that connect, even to answering machines, voicemail, or voice transcription services. You won't be charged for unanswered calls or if you get a busy signal. For incoming calls answered, you're charged from the time shortly before the device starts ringing until you press "End" or the network connection otherwise breaks. You're charged for the entire call based on the rate that applies to the time period in which the call starts. However, the types of charges actually deducted from your account balance will vary depending on your Service. Call time data displayed on your device may be inaccurate and may not be relied upon for determining charges to your account. Call time for a single call may be limited. If the call exceeds the limit, then it may be automatically terminated.
Data Usage: Unless we specifically tell you otherwise, data usage is measured in bytes, kilobytes, megabytes, and gigabytes—not in minutes/time. 1024 bytes equals 1 kilobyte ("KB"), 1024 KB equals 1 megabyte, and 1024 megabytes equals 1 gigabyte. Bytes are rounded up to KB, so you will be charged at least 1 KB for each data usage session ("data session"). Rounding occurs at the end of each data session and sometimes during a data session. Depending on your data Services, usage may be charged against an allowance or on a fixed price per KB, and you may be subject to limitations on the amount of data usage. If you are charged on a fixed price per KB, any fractional cents will be rounded up to the next cent. You are charged for all data directed to your device's Internet address, including data sessions you did not initiate and for incomplete transfers. As long as your device is connected to our data networks, you may incur data charges. Examples of data for which you will be charged includes the size of a requested file or data content (game, ringer, etc.); web page graphics (logos, pictures, banners, advertisement, etc.); additional data used in accessing, transporting, and routing the file on our network; data from partial or interrupted downloads; re-sent data; and data associated with unsuccessful attempts to reach websites or use applications. These data charges are in addition to any charges for the data content itself (game, ringer, etc.). Data used and charged to you will vary widely, even between identical actions or data sessions. Estimates of data usage—for example, the size of downloadable files—are not reliable predictors of actual usage.
D. Use of Service/Rates. Your service rates and other charges and conditions for each number or phone are described at our website at www.vectomobile.com, each of which is a part of this Agreement. You can place domestic and international calls from the U.S. to certain designated international locations. The prepaid per minute rates are based on your Pre-paid Monthly Subscription Plan or PAYG bundle purchased. International rates vary and are subject to change.
The term "roaming" typically refers to coverage on another carrier's network that we may make available to you based on our agreements with other carriers. These agreements may change from time to time, and roaming coverage is subject to change without notice. Your ability to receive roaming coverage depends on the radio transmissions your device can pick up and the availability of roaming coverage. We make no guarantee that roaming coverage will be available.
Visit www.vectomobile.com for international rates and available countries applicable to your Vecto Mobile plan. You cannot use the service to place calls to 500, 700, 855, 900 or 976 numbers; or to place operator-assisted calls such as third-party-billed, and collect calls. You will be billed at domestic rates for 800, 888, 877, and 866 number calls You are responsible for all taxes and surcharges associated with your use of the Service. Other than calls to 911, you can only make and receive calls when your account has a positive balance. Special dialing patterns may be required when making roaming or international calls. When using Call Waiting or Three-Way Calling, you will incur two simultaneous airtime charges and if you disconnect from a conference call while the other two parties remain connected, you will continue to incur airtime charges for all calls. Directory assistance, Call Forwarding, 3-way Calling and Roaming are NOT available for Vecto Mobile or monthly plans.
E. Default/Termination. If you breach any representation to us or fail to perform any of the promises you made in the Agreement, you will be in default and we may, without notice to you, suspend Service and/or terminate this Agreement, in addition to all other remedies available to us.
F. Account Information. Any person able to provide your number and personal identification number is authorized by you to make changes to your account. You consent to disclosure of any information about you to any person as permitted by law if any device programmed with your Number calls an emergency service number such as 911 or, if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.
G. CPNI Consent. Under federal law, you have a right, and we have a duty, to protect the confidentiality of information about the amount, type, and destination of your wireless service usage (CPNI). You consent to us sharing your CPNI with Vecto Mobile, its affiliates and its contractors, to develop or bring to your attention any products and services. This consent survives the termination of your Service and is valid until you remove it. To remove this consent at any time, notify us in writing at Vecto Mobile email@example.com providing your name, home address, home telephone including area code, and personal identification number. Removing consent will not affect your current Service. If your CPNI information is compromised in any way by a security breach, you will be notified in accordance with the Notification clause of this Agreement as required under federal law.
III. INTENDED USAGE & RESTRICTIONS ON USE.
You agree that the Vecto Mobile plans are to be used for voice and SMS messaging only between two individuals. You agree that the Service is not to be used for any type of monitoring service, data transmission, transmission of recorded material or broadcasts, call forwarding, conference calling or other use that does not consist of uninterrupted live voice or SMS messaging between two individuals. Vecto Mobile may terminate or suspend service if Vecto Mobile determines that you are using the unlimited service offer in an unauthorized manner as described in this section. Vecto Mobile will make reasonable efforts to give prior notice before taking any above action and you may terminate the unlimited service.
B. Vecto Mobile Service Plans may ONLY be used for the following purposes: (i) Person to Person Voice Calls (ii) Text and Picture Messaging and (iii) Internet browsing through the Vecto Mobile web service. Vecto Mobile service MAY NOT be used for any other purpose. Examples of prohibited uses include, without limitation, the following: (i) continuous mobile to mobile or mobile to landline voice calls; (ii) automated text or picture messaging to another mobile device or e-mail address; (iii) uploading, downloading or streaming of audio or video programming or games; (iv) server devices or host computer applications, including, but not limited to, Web camera posts or broadcasts, automatic data feeds, automated machine-to-machine connections or peer-to-peer (P2P) file sharing; or (v) as a substitute or backup for private lines or dedicated data connections. This means, by way of example only, that checking email, surfing the Internet, downloading legally acquired songs, and/or visiting corporate intranets is permitted, but downloading movies using P2P file sharing services and/or redirecting television signals for viewing on laptops is prohibited. A person engaged in prohibited uses may have his/her service terminated without notice or a refund.
C. Vecto Mobile Service Plans are for individual use only and not for resale. Specifically, Vecto Mobile services are provided solely for live dialogue between, and initiated by, two individuals for personal use and as otherwise described in this policy. Voice Services may not be used for any other purposes, including, but not limited to, conference calling, monitoring services, data transmissions, transmission of broadcasts, transmission of recorded material, interconnection to other networks, telemarketing, autodialed calls, other commercial uses, or other connections that do not consist of uninterrupted live dialogue between two individuals.
D. Vecto Mobile reserves the right to cancel or deactivate service, and/or reduce data throughput, without notice, in order to protect the Carrier’s network from harm due to any cause including, without limitation, the excessive and/or improper use of Vecto Mobile Service. Vecto Mobile reserves the right to limit or reduce data throughput speeds or the amount of data transferred, block particular websites, and to deny or terminate Service, without notice, to anyone Vecto Mobile believes is using Vecto Mobile service in any manner prohibited above or whose usage, in Vecto Mobile’s sole discretion, adversely impacts the Carrier’s network or customer service levels. Vecto Mobile will presume you are engaging in a prohibited use in violation of these Terms and Conditions if in Vecto Mobile’s sole opinion your talk, text or Mobile Web usage is harmful or disruptive to the Carrier’s network or services. If we determine, at our sole discretion, that you are using Vecto Mobile service in violation of the Vecto Mobile Terms and Conditions of Service, or in any other manner that we deem to be unreasonable, then we may terminate individual calls, terminate or reduce the speed of data connection throughput, Mobile Web Access or terminate your service, decline to renew your service and/or block particular websites. Notwithstanding the foregoing, Vecto Mobile reserves the right to deny service, deactivate or cancel existing service, block particular websites, terminate data connections and/or reduce data throughput speeds, to anyone for any reason at any time, in Vecto Mobile’s sole discretion.
E. Vecto Mobile may modify or cancel any Service or take corrective action at any time without prior notice and for any reason, including but not limited to your violation of this agreement.
G. If Vecto Mobile terminates this Agreement for these reasons, your SIM Card will be deactivated. If the SIM Card is deactivated, your specific telephone number will be reallocated to another Customer, you will not be able to access or use the Services, and you will not be entitled to a refund of any credit balance in your Account.
The parties intend that the limitations on liability, warranty and damage awards provided for in this Agreement will apply to the fullest extent allowed by law. Some jurisdictions do not allow the exclusion of certain warranties or the waiver, limitation or exclusion of liability for punitive, incidental or consequential damages, or for intentional or willful conduct in some circumstances. To the extent that applicable law does not permit any of these limitations, they will not apply to you.
A. Limitation of Liability. VECTO MOBILE DOES NOT ACCEPT ANY LIABILITY FOR THE DELIVERY, PERFORMANCE AND USE OF THE PRODUCTS AND SERVICES OTHER THAN AS STATED IN THIS AGREEMENT. WE ARE NOT LIABLE FOR ACTS OR OMISSIONS OF ANOTHER SERVICE PROVIDER OR ANY THIRD PARTY PROVIDERS OF SERVICES RELATED TO USE OF THE DEVICE OR SERVICE, FOR INFORMATION PROVIDED THROUGH YOUR DEVICE, LACK OF PRIVACY OR SECURITY EXPERIENCED WHEN USING THE DEVICE, EQUIPMENT FAILURE OR MODIFICATION, OR OTHER CAUSES BEYOND OUR REASONABLE CONTROL, INCLUDING WITHOUT LIMITATION ANY REPRESENTATIONS THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM UNAUTHORIZED ACCESS (INCLUDING THIRD PARTY HACKERS OR DENIAL OF SERVICE ATTACKS). WE ARE NOT LIABLE FOR SERVICE OUTAGES, NOR FOR SERVICE LIMITATIONS OR INTERRUPTIONS, AS DESCRIBED IN THIS AGREEMENT. OUR LIABILITY AND THE LIABILITY OF ANY UNDERLYING CARRIER FOR ANY FAILURE OR MISTAKE SHALL IN NO EVENT EXCEED OUR SERVICE CHARGES DURING THE AFFECTED PERIOD. VECTO MOBILE AND ANY UNDERLYING CARRIER ARE NOT LIABLE FOR ANY INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES SUCH AS LOST PROFITS. YOU AND WE BOTH WAIVE TO THE FULLEST EXTENT ALLOWED BY LAW, ANY CLAIMS TO RECOVER INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. WE AND ANY UNDERLYING CARRIER ARE NOT LIABLE FOR (i) ECONOMIC LOSS OR INJURIES TO PERSONS OR PROPERTY ARISING FROM USE OF THE SERVICE, THE DEVICE OR ANY EQUIPMENT USED IN CONNECTION WITH THE DEVICE., (ii) THE INSTALLATION OR REPAIR OF THE DEVICE BY ANY PARTIES WHO ARE NOT OUR EMPLOYEES. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT. VECTO MOBILE IS NOT LIABLE FOR ANY LOSS OF CUSTOMER INFORMATION ON CUSTOMER’S DEVICE. THIS IS INCLUDING BUT NOT LIMITED TO CUSTOMER CONTACTS, E-MAIL AND VOICE-MAIL.
B. Indemnification. YOU SHALL INDEMNIFY AND HOLD VECTO MOBILE, ITS OFFICERS, EMPLOYEES, SUPPLIERS OF SERVICE AND AGENTS HARMLESS AGAINST ANY AND ALL CLAIMS, DEMANDS, SUITS, JUDGMENTS, CAUSES OF ACTION, LOSSES, EXPENSES, FEES (INCLUDING REASONABLE ATTORNEY'S FEES), AND LIABILITY OR DAMAGES FOR LIBEL, SLANDER OR INFRINGEMENT OF COPYRIGHT FROM THE MATERIAL TRANSMITTED VIA THE ACCESS TELEPHONE NUMBER, AND AGAINST ANY AND ALL OTHER CLAIMS, DEMANDS, SUITS, JUDGMENTS, CAUSES OF ACTION, LOSSES, EXPENSES, FEES (INCLUDING REASONABLE ATTORNEY'S FEES), LIABILITY, INCLUDING WITHOUT LIMITATION FOR ANY PERSONAL INJURY OR DEATH, ARISING IN ANY WAY DIRECTLY OR INDIRECTLY IN CONNECTION WITH THIS AGREEMENT OR THE USE OR INABILITY TO USE THE ACCESS TELEPHONE NUMBER (WHETHER CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF SUPPLIERS OF SERVICE). THIS INDEMNITY SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT. YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD US, OUR AFFILIATES AND AGENTS AND ANY OTHER SERVICE PROVIDER, HARMLESS FROM CLAIMS OR DAMAGES RELATING TO THIS AGREEMENT OR YOUR PROMISES OR STATEMENTS MADE IN IT AND USE OF THE DEVICE OR SERVICE. YOU ALSO AGREE TO PAY OUR REASONABLE ATTORNEYS' AND EXPERT WITNESS FEES AND COSTS INCURRED IN ENFORCING THIS AGREEMENT THROUGH APPEAL EXCEPT AS PROVIDED IN PARAGRAPH 5, BELOW. USE OF YOUR DEVICE WHILE OPERATING A MOTOR VEHICLE OR IN ANOTHER DISTRACTED OR NEGLIGENT MANNER MAY BE PROHIBITED, OR RESTRICTED BY LAW IN SOME AREAS. IT IS YOUR RESPONSIBILITY TO CONFORM TO ALL SUCH LAWS OR REGULATIONS AND YOU SHALL INDEMNIFY US FROM CLAIMS ARISING FROM ANY SUCH UNLAWFUL OR NEGLIGENT USE. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
C. No Warranties. WE MAKE NO EXPRESS WARRANTY REGARDING THE SERVICE OR THE DEVICE OR ANY SERVICES PROVIDED BY ANY THIRD PARTIES, AND DISCLAIM ANY IMPLIED WARRANTY, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT AUTHORIZE ANYONE TO MAKE ANY WARRANTY ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT. WE ARE NOT THE MANUFACTURER OF THE DEVICE AND ANY STATEMENT REGARDING IT SHOULD NOT BE INTERPRETED AS A WARRANTY. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
V. RESOLUTION OF DISPUTE
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS RIGHTS THAT YOU MAY OTHERWISE HAVE. IT PROVIDES FOR RESOLUTION OF MOST DISPUTES THROUGH ARBITRATION INSTEAD OF COURT TRIALS AND CLASS ACTIONS. ARBITRATION IS FINAL AND BINDING AND SUBJECT TO ONLY VERY LIMITED REVIEW BY A COURT. THIS ARBITRATION CLAUSE SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
B. Arbitration Procedures. You must first present any claim or dispute to us by contacting Customer Care to allow us an opportunity to resolve the dispute. You and Vecto Mobile each agree to first provide to the other a written notice ("Notice of Dispute"), which shall contain: (a) a written description of the problem and relevant documents and supporting information. (b) A statement of the specific relief sought. A Notice of Dispute to Vecto Mobile should be sent to: 9100 South Dadeland Blvd., Suite 912, Miami, FL 33156. Vecto Mobile will provide a Notice of Dispute to you in accordance with the "Providing Notice to Each Other under the Agreement"section of this Agreement. Vecto Mobile will assign a representative to work with you and try to resolve your dispute to your satisfaction. You and Vecto Mobile agree to make attempts to resolve the dispute prior to commencing an arbitration or small claims action. You may request arbitration if your claim or dispute has not been resolved within 90 days.
(1) Unless you and Vecto Mobile agree otherwise, the arbitration will be conducted by a single, neutral arbitrator and will take place in Miami, Florida. The arbitration will be governed by either: (a) rules that we mutually agree upon; or (b) the JAMS Comprehensive Arbitration Rules & Procedures (the "JAMS Rules"), as modified by this agreement to arbitrate, including the rules about the filing, administration, discovery and arbitrator fees. The JAMS Rules are available on its website at jamsadr.com. Notwithstanding any JAMS Rules to the contrary or any other provision in arbitration rules chosen, by agreement, to govern the arbitration, we each agree that all issues regarding the dispute are delegated to the arbitrator to decide, except that only a court (and not the arbitrator) shall decide any disagreements regarding the scope and enforceability of this agreement to arbitrate.
(2) The Federal Arbitration Act ("FAA") applies to this Agreement and arbitration provision. We each agree that the FAA's provisions-not state law shall govern all questions of whether a dispute is subject to arbitration. To the extent that this agreement to arbitrate conflicts with the JAMS Policy on Consumer Arbitrations Pursuant to Pre-Dispute Clauses Minimum Standards for Procedural Fairness (the "Minimum Standards"), the Minimum Standards in that regard will apply. However, nothing in this paragraph will require or allow you or Vecto Mobile to arbitrate on a class-wide, representative or consolidated basis.
(3) The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. YOU AND VECTO MOBILE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A CLASS MEMBER IN ANY PUTATIVE CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Vecto Mobile expressly agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If any portion of this provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
(4) For claims of less than $1,000, you will be obligated to pay $25 and we will pay all other administrative costs and fees. For claims over $1,000 but under $75,000, you will be obligated to pay your share of the arbitration fees, but no more than the equivalent court filing fee for a court action filed in the jurisdiction where your billing address is located. For arbitrations in excess of $75,000, all administrative fees and expenses of arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.
(5) An arbitrator's award will be a written statement of the disposition of each claim and will also provide a concise written statement of the essential findings and conclusions which form the basis of the award. The arbitrator's decision and award is final and binding, with some limited court review under the FAA, and judgment on the award may be entered in any court with jurisdiction.
(6) As an alternative to arbitration, we may resolve disputes in small claims court in the county of your most recent billing address. In addition, this arbitration agreement does not prevent you from bringing your dispute to the attention of any federal, state, or local government agency. Such agencies can, if the law allows, seek relief against Vecto Mobile on your behalf.
C. No Trial by Jury and No Class Actions. IF FOR ANY REASON A CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT IN ANY WAY PROCEEDS IN COURT RATHER THAN IN ARBITRATION, REGARDLESS OF WHETHER THE CLAIM IS AN ACTION, COUTERCLAIM OR ANY OTHER COURT PROCEEDING, WE EACH AGREE THAT TO THE EXTENT ALLOWED BY LAW, THERE WILL NOT BE A JURY TRIAL OR CLASS ACTION AND WE EACH UNCONDITIONALLY (1) WAIVE ANY RIGHT TO TRIAL BY JURY AND (2) WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASSWIDE BASIS, INCLUDING JOINING A CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY OR ASSERT A CLAIM IN A REPRESENTATIVE CAPACTITY ON BEHALF OF ANYONE ELSE IN ANY OTHER PROCEEDING
D. Indemnification. You agree to indemnify, defend, and hold Vecto Mobile and our subsidiaries, affiliates, parent companies, vendors, suppliers, and licensors harmless from any claims arising out of or relating to your actions, including, but not limited to, your use of the Service and any information you submit, post, transmit, or make available via the Service; failing to provide appropriate notices regarding location-enabled services (see "Location-Enabled Services" section); failure to safeguard your passwords, backup question to your shared secret question, or other account information; or violating this Agreement or any policy referenced in this Agreement, any applicable law or regulation, or the rights of any third party
E. Waiver of Class Actions. If for any reason this arbitration clause is deemed inapplicable or invalid, or to the extent this arbitration clause allows for litigation of disputes in court, you and we both waive, to the fullest extent allowed by law, any right to pursue any claims on a class or consolidated basis or in a representative capacity
F. Limitations Period. Any arbitration or legal action with respect to any and all claims or causes of action related to or arising out of this Agreement must be brought within two years after the cause of action arises, or within the applicable statutory period of time, whichever is shorter. This limitations period does not apply to any given cause of action when the statutory limitations period for that cause of action cannot be waived, restricted or otherwise limited by you.
Not all plans or Services are available for purchase or use in all sales channels, in all areas or with all devices. Vecto Mobile is not responsible for loss or disclosure of any sensitive information you transmit. Vecto Mobile’s wireless services are not equivalent to landline Internet. Vecto Mobile is not responsible for nonproprietary services or their effects on devices. VECTO MOBILE RESERVES THE RIGHT TO TERMINATE YOUR SERVICES WITH OR WITHOUT CAUSE, INCLUDING WITHOUT LIMITATION, UPON EXPIRATION OR TERMINATION OF YOUR WIRELESS SERVICE. You may receive unsolicited messages from third parties as a result of visiting Internet sites, and a per-message charge may apply whether the message is read or unread, solicited or unsolicited.
A. Privacy. We are not liable for any lack of privacy, which may be experienced with regard to the Service. You authorize our monitoring and recording of calls to us concerning your account or the Service and consent to our use of automatic dialing equipment to contact you. We have the right to intercept and disclose any transmission over our facilities in order to protect our rights or property.
B. Assignment. We may assign all or part of this Agreement without such assignment being considered a change to the Agreement and without notice to you. We are then released from all liability. You may not assign this Agreement without our prior written consent.
C. Notices. We may send you notice by mail or electronic means, in our sole discretion. Notices to you shall be effective: 1) 3 days following the date deposited in the U.S. Mail or delivered to a nationally recognized courier or delivery service, postage prepaid and addressed to your address as kept in our files. 2) Immediately upon our transmission using an electronic means such as e-mail or text messaging service. You are responsible for notifying us of any changes in your mailing or e-mail address. Written notice to us shall be effective when directed to our Customer Care Department (at the mailing address listed on our website) and received by us. Oral and electronic notices shall be deemed effective on the date reflected in our records. Your notice must contain specific information adequate to identify you and your Service.
D. Providing Notice to Each Other Under the Agreement. Except as the Agreement specifically provides otherwise, you must deliver written notice to us by mail to firstname.lastname@example.org or email to email@example.com. We will provide you notice by correspondence to your last known address in our records, to any fax number or email address you've provided us, by calling you on your device or any other phone number you've provided us, by voice message on your device or any other phone number you've provided us, or by text message on your device.
E. Entire Agreement. These Terms and Conditions represent the entire agreement between you and us, which may only be amended as described in this Agreement. This Agreement supersedes any inconsistent or additional representations made to you by any of our representatives, agents or dealers. If any part of this Agreement is found invalid, the balance of the Agreement remains enforceable. If, at any time, we do not enforce any right or remedy available under this Agreement, that failure is not a waiver of our right to enforce the right or remedy at a later time. Copied, microfiche, scanned or other duplicate or electronic images of this Agreement are admissible for all purposes.
F. Governing Laws. This Agreement is subject to applicable federal laws, federal or state tariffs, if any, and the laws of the state associated with the number. Where a state agency or the FCC regulates the terms and conditions of our Service, the regulations are available for your inspection; if there is any inconsistency between this Agreement and those regulations, this Agreement shall be deemed amended as necessary to conform to such regulations.
H. Capacity. You represent that you are legally competent to enter into this Agreement, and that you are not aware of any disability that would prevent you from entering into this Agreement.
By registering for the Services you consent to us transferring your personal data to countries which do not provide the same level of data protection as the United States if we deem it necessary for the provision of the Services.
We will always use and process your personal data in compliance with applicable data protection law and regulation, as amended from time to time.
J. Marketing. In order for Vecto Mobile to provide the Service as a low cost service we may rely on advertising and marketing supplied through the Service and other mechanisms to subsidize the Service. We intend that any such marketing services shall be discreet and of targeted interest to you. By agreeing to this Agreement you agree to receive such advertising and marketing information.
